You warrant that your content does not infringe on others’ rights.

We reserve the right to review, modify, or remove Customer Content at our discretion.

We reserve the right to terminate or suspend your access at any time, without prior notice, for any violation of these Terms or other reasons. Upon termination, you must cease using the Service, and any licenses granted to you will be revoked.

"AS IS" and "AS AVAILABLE" Disclaimer

The Service is provided without warranties of any kind. We do not guarantee that the Service will be uninterrupted, secure, or error-free, or that any content is accurate or reliable.

Limitation of Liability

To the maximum extent permitted by law, our liability is limited to the greater of $100 or the amount you paid us in the 12 months prior to the event giving rise to liability. We are not liable for indirect, incidental, or consequential damages.

Dispute Resolution

Before initiating formal legal proceedings, you agree to attempt to resolve any dispute with us informally by contacting support@marly.ai. If a resolution isn’t reached within 60 days, either party may initiate binding arbitration (except for qualifying claims in small claims court).

Arbitration Agreement

Except for small claims, any disputes arising from or relating to these Terms or your use of the Service shall be resolved through binding arbitration under the AAA Consumer Arbitration Rules. You waive the right to a jury trial or to participate in class actions. This section survives termination of these Terms.

Governing Law

These Terms are governed by the laws of the State of California, excluding conflict of law rules. You agree that any non-arbitrated disputes will be brought in courts located in California.

Severability and Waiver

If any provision is deemed invalid, the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver of our right to do so later.

Changes to These Terms and Conditions

We may update these Terms at any time. Material changes will be notified at least 30 days in advance. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
